A BILL to amend article five, chapter eighteen of the code of West Virginia, one thousand nine hundred thirty-one, as amended, by adding thereto a new section, designated section sixteen-c, relating to transferring students to a contiguous state.

Be it enacted by the Legislature of West Virginia:

That article five, chapter eighteen of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be amended by adding thereto a new section, designated section sixteen-c, to read as follows:
ARTICLE 5. COUNTY BOARD OF EDUCATION.

§ 18-5- 1 6c. Transferring pupils out of state; cost for transportation and education.

Whenever, in the opinion of the board of education of any county, the education and welfare of any pupil would be enhanced, the board of education of such county shall have the authority to transfer any such pupil or pupils on a part-time or full-time basis from one school district to another school district in a contiguous state. Where the board of education in a contiguous state provides transportation to a pupil or pupils to and from the place of residence in West Virginia to the school in the contiguous state, the West Virginia county board of education may pay the school board of the contiguous state for providing the transportation and education: Provided, That the West Virginia county board of education shall retain those students so transported for purposes of state funding.




NOTE: The purpose of this bill is to authorize a county board of education, upon a determination that it is in the best interest of a pupil, to be transferred to a school in a contiguous state and to pay the contiguous state for the costs of transportation and education.
